1. מי אנחנו והסכמה לתנאים
Untie היא אפליקציה שעוזרת להפסיק או להפחית שימוש בקנאביס, סיגריות, וייפים, אלכוהול וסמים. מפעילה אותה Untie, ישראל ("Untie", "אנחנו").
התנאים האלה, יחד עם מדיניות הפרטיות, הם ההסכם בינך לבין Untie. השימוש באפליקציה, ואישור התנאים במסך הפתיחה, הם הסכמה להם. אם משהו לא מתאים לך, אפשר להפסיק להשתמש ולמחוק את הנתונים בכל רגע. התנאים כתובים בלשון שבחרת באפליקציה ומיועדים לכל המגדרים.
2. גיל ותנאי זכאות
Untie מיועדת לבני 18 ומעלה בלבד. באישור התנאים את או אתה מצהירים שמלאו לך 18 ושמותר לך לפי הדין החל עלייך להתקשר בהסכם הזה. אם עוד לא מלאו לך 18 ואת או אתה מתמודדים עם שימוש, אפשר לדבר עם הורה, יועצת בית הספר או רופא המשפחה, או להתקשר לער״ן 1201.
3. תמיכה, לא טיפול רפואי
Untie היא כלי לתמיכה עצמית. היא לא שירות רפואי, לא טיפול פסיכולוגי, לא גמילה רפואית ולא תחליף לאיש מקצוע.
היא לא מאבחנת, לא ממליצה על תרופות ולא קובעת מינונים.
המידע באפליקציה, כולל תכנים של אנשי מקצוע, הוא מידע כללי. הוא לא מחליף בדיקה או ייעוץ אישי.
לפני כל החלטה רפואית יש להתייעץ עם רופא. בהפסקה של אלכוהול אחרי שתייה כבדה, של כדורי הרגעה (בנזודיאזפינים) או של אופיואידים, אסור להפסיק בבת אחת בלי ליווי רפואי, כי תסמיני גמילה עלולים להיות מסוכנים.
Untie לא שירות חירום. אף אחד לא עוקב בזמן אמת אחרי מה שנכתב באפליקציה.
4. המלווה
המלווה הוא תוכנה של בינה מלאכותית (מודל Claude של Anthropic), לא אדם ולא איש מקצוע.
הוא יכול לטעות, להבין לא נכון, להמציא פרטים או לתת עצה שלא מתאימה לך. אין להסתמך עליו בהחלטות רפואיות, משפטיות או כספיות.
הוא לא יעזור להשיג חומרים, לא ייתן מינונים ולא יעזור במשהו שמסכן אותך או אחרים. כשעולה סימן לסכנה, הוא יפנה למספרי החירום.
השימוש במלווה מותנה בהסכמה נפרדת לשליחת השיחה ל־Anthropic בארצות הברית, ואפשר לכבות אותו בהגדרות. הפרטים במדיניות הפרטיות.
אסור לנסות לגרום למלווה לעקוף את כללי הבטיחות שלו או להשתמש בו כדי לייצר תוכן אסור.
5. הקהילה וכללי ההתנהגות
הקהילה היא מקום לשתף מה עזר לך, בשם בדוי. כדי שתישאר בטוחה יש בה כללים ברורים, ויש בה אפס סובלנות לתוכן פוגעני ולמשתמשים פוגעניים.
אסור:
להעליב, לאיים, להטריד, לבייש או להפלות אף אחד.
לעודד שימוש, למכור, לקנות או להפנות למקום שבו משיגים חומרים.
לתת מינונים או הוראות שימוש.
לעודד פגיעה עצמית או פגיעה באחרים.
לפרסם פרטים מזהים, שמות, טלפונים, כתובות, קישורים או תמונות, שלך או של אחרים.
לפרסם פרסומות, ספאם, תוכן מיני או תוכן שמפר זכויות של אחרים.
להתחזות לאדם אחר או לאיש מקצוע.
דיווח וחסימה. ליד כל תובנה יש כפתור דיווח. תובנה שדווחה מוסתרת מיד עד שהצוות בודק אותה, והצוות בודק דיווחים תוך 24 שעות. אפשר גם להסתיר את כל התובנות של כותב מסוים. על כל בעיה אפשר לכתוב ל־shonm1921@gmail.com.
אכיפה. אנחנו רשאים להסיר כל תוכן שמפר את הכללים, ולהפסיק את הגישה לקהילה או לאפליקציה כולה למי שמפר אותם, בלי התראה מראש.
מה ששיתפת. האחריות למה שמשתפים היא שלך. כשמשתפים תובנה, נותנים לנו רשות שאינה בלעדית וללא תמורה להציג אותה בקהילה, כל עוד היא לא נמחקה. אפשר למחוק אותה בכל רגע.
6. החשבון, קוד השחזור והמכשיר
אין ב־Untie שם משתמש וסיסמה. החשבון הוא מזהה אנונימי שנשמר במכשיר. קוד השחזור הוא הדרך היחידה להעביר את הנתונים למכשיר חדש, ומי שמחזיק בו יכול לראות את הנתונים שלך. יש לשמור אותו במקום פרטי. אם הקוד אבד, אין לנו דרך לשחזר את הנתונים. האחריות לאבטחת המכשיר ולנעילתו היא שלך.
7. שימושים אסורים
אסור להשתמש ב־Untie בניגוד לדין או לתנאים האלה, ובפרט:
לנסות לפרוץ למערכת, לעקוף הגבלות או מנגנוני אבטחה, או לחשוף פגיעויות בלי לדווח עליהן לנו.
להפעיל את השירות באופן אוטומטי, לגרד תוכן (scraping) או להעמיס עליו בהיקף חריג.
להעתיק, לשנות, להפיץ, למכור או לבצע הנדסה לאחור לאפליקציה, מעבר למה שהחוק מתיר במפורש.
לאסוף מידע על משתמשים אחרים או לנסות לזהות אותם.
8. תשלומים
כרגע השימוש ב־Untie לא כרוך בתשלום, והתוכנית של 90 הימים מוצגת כגרסת הדגמה בלי חיוב בפועל. אם יוצעו בעתיד רכישות, הן יבוצעו רק דרך ה־App Store של Apple, לפי תנאי התשלום, הביטול וההחזרים של Apple, והמחיר והתנאים יוצגו לפני כל רכישה. תנאים מיוחדים לרכישה כזו יפורסמו מראש ויהיו חלק מהתנאים האלה. אין בהם כדי לפגוע בזכויות לפי חוק הגנת הצרכן.
9. קניין רוחני ורישיון שימוש
האפליקציה, העיצוב, האיורים והסצנות, הטקסטים, התוכן המקצועי והקוד שייכים ל־Untie או למי שהתיר לה להשתמש בהם. אנחנו מעניקים לך רישיון אישי, מוגבל, שאינו בלעדי, שאינו ניתן להעברה וניתן לביטול, להשתמש באפליקציה במכשירים שבבעלותך או בשליטתך, לשימוש אישי שאינו מסחרי, בהתאם לתנאים האלה ולכללי השימוש של ה־App Store. מה שכתבת ביומן ובצ׳ק־אינים שייך לך.
10. זמינות ושינויים בשירות
אנחנו משתדלים שהשירות יהיה זמין, אבל לא מתחייבים לזמינות רציפה. חלקים שדורשים חיבור לשרת, כמו המלווה, הקהילה והסנכרון, עשויים להיות לא זמינים לפעמים. מסך הבית, כפתור הדחף, הצ׳ק־אין והידע עובדים גם בלי חיבור. אנחנו רשאים לשנות, להוסיף או להפסיק חלקים מהשירות. לפני הפסקה של השירות כולו נודיע מראש באפליקציה, כדי שיהיה אפשר להוריד עותק של הנתונים.
11. הגבלת אחריות
אנחנו עושים מאמץ סביר שהאפליקציה תעבוד היטב ושהמידע בה יהיה מדויק. עם זאת, השירות ניתן כפי שהוא (AS IS) וכפי שהוא זמין, ויכולים להיות בו תקלות, הפסקות וטעויות.
התוצאה של הפסקה או הפחתה של שימוש תלויה בגורמים רבים, ואיננו מבטיחים תוצאה מסוימת.
במידה המרבית שהדין מתיר, Untie לא תהיה אחראית לנזק עקיף, תוצאתי או מיוחד, ולא לנזק שנגרם מהסתמכות על מידע באפליקציה או על תשובות המלווה במקום פנייה לרופא או לשירותי חירום, או מתוכן שמשתמשים אחרים פרסמו.
במידה המרבית שהדין מתיר, האחריות הכוללת של Untie כלפיך לא תעלה על הסכום ששילמת ל־Untie, אם שילמת, ב־12 החודשים שלפני האירוע.
שום דבר בתנאים האלה לא מגביל אחריות שהדין לא מאפשר להגביל, כמו אחריות למוות או לנזק גוף שנגרם ברשלנות או אחריות למרמה, ולא פוגע בזכויות שלך לפי חוק הגנת הצרכן, התשמ״א־1981.
12. שיפוי
אם תוגש נגד Untie תביעה בגלל תוכן שפרסמת בקהילה או בגלל שימוש שעשית באפליקציה בניגוד לתנאים או לדין, תשפו את Untie על הנזק וההוצאות הסבירות שנגרמו לה, לאחר שנודיע לך על התביעה ונאפשר לך להתגונן מפניה.
13. סיום השימוש
אפשר להפסיק להשתמש בכל רגע ולמחוק את כל הנתונים בהגדרות. אנחנו רשאים להשעות או להפסיק את הגישה של מי שמפר את התנאים או את הדין. הסעיפים שמטבעם נועדו להמשיך לחול, כמו קניין רוחני, הגבלת אחריות, שיפוי והדין החל, ימשיכו לחול גם אחרי סיום השימוש.
14. תנאים לגבי Apple
אם הורדת את Untie מה־App Store:
ההסכם הוא בינך לבין Untie בלבד, ולא עם Apple Inc. Untie, ולא Apple, אחראית לאפליקציה ולתוכן שלה.
הרישיון בסעיף 9 מוגבל לשימוש במוצרי Apple שבבעלותך או בשליטתך, לפי כללי השימוש שבתנאי השירות של ה־App Store.
Untie, ולא Apple, אחראית לתחזוקה ולתמיכה באפליקציה. ל־Apple אין שום חובה לספק תחזוקה או תמיכה.
אם האפליקציה לא עומדת באחריות שחלה עליה לפי דין, אפשר להודיע ל־Apple, ו־Apple תחזיר את מחיר הרכישה, אם שולם. במידה המרבית שהדין מתיר, ל־Apple לא תהיה שום חובת אחריות אחרת לגבי האפליקציה.
Untie, ולא Apple, אחראית לטפל בכל טענה שלך או של צד שלישי בקשר לאפליקציה, כולל טענות לאחריות למוצר, טענה שהאפליקציה לא עומדת בדרישות חוקיות או רגולטוריות, וטענות לפי דיני הגנת הצרכן, הפרטיות או דינים דומים.
אם צד שלישי יטען שהאפליקציה או השימוש בה מפרים את הקניין הרוחני שלו, Untie, ולא Apple, תהיה אחראית לבדיקה, להגנה, ליישוב ולסילוק הטענה.
את או אתה מצהירים שאינכם נמצאים במדינה שחל עליה אמברגו של ממשלת ארצות הברית או שהוגדרה על ידה כמדינה תומכת טרור, ושאינכם ברשימה של גורמים אסורים או מוגבלים של ממשלת ארצות הברית.
בשימוש באפליקציה יש לעמוד גם בתנאים של צדדים שלישיים שחלים עליך, למשל תנאי ספק האינטרנט.
Apple Inc. והחברות הבנות שלה הן מוטבות צד שלישי של התנאים האלה, ומרגע שאישרת אותם Apple רשאית לאכוף אותם כלפיך.
15. שינויים בתנאים
אנחנו רשאים לעדכן את התנאים. שינוי מהותי יפורסם באפליקציה לפני שהוא נכנס לתוקף, ובמקרה הצורך נבקש את הסכמתך מחדש. המשך השימוש אחרי שהשינוי נכנס לתוקף הוא הסכמה לו. בראש העמוד תמיד מופיעים מספר הגרסה והתאריך שבו היא נכנסה לתוקף.
16. הדין וסמכות השיפוט
על התנאים האלה חל הדין הישראלי בלבד, בלי כללי ברירת הדין שלו. סמכות השיפוט הבלעדית נתונה לבתי המשפט המוסמכים בתל אביב-יפו. אין בכך כדי לשלול זכות שעומדת לך לפי דין מחייב במדינה שבה את או אתה גרים.
17. הוראות כלליות
אם הוראה בתנאים תימצא בלתי תקפה, שאר ההוראות ימשיכו לחול. ויתור על הפרה אחת אינו ויתור על הפרה אחרת. Untie רשאית להעביר את זכויותיה וחובותיה לפי התנאים האלה לגורם שימשיך להפעיל את השירות, בכפוף למדיניות הפרטיות. במקרה של סתירה בין הנוסח העברי לנוסח האנגלי, הנוסח העברי קובע.

1. Who we are and agreement
Untie is an app that helps you quit or cut down on cannabis, cigarettes, vapes, alcohol and drugs. It is operated by Untie, Israel ("Untie", "we").
These terms, together with the Privacy Policy, are the agreement between you and Untie. By using the app and accepting the terms on the welcome screen, you agree to them. If something does not suit you, you can stop using the app and delete your data at any time.
2. Age and eligibility
Untie is for people aged 18 and over only. By accepting these terms you confirm that you are at least 18 and legally able to enter into this agreement under the law that applies to you. If you are under 18 and struggling with use, you can talk to a parent, a school counselor or your family doctor, or call ERAN at 1201 in Israel.
3. Support, not medical care
Untie is a self-help support tool. It is not a medical service, psychological treatment, medical detox or a substitute for a professional.
It does not diagnose, recommend medication or set doses.
Information in the app, including content by professionals, is general information. It does not replace an examination or personal advice.
Consult a doctor before any medical decision. When stopping alcohol after heavy drinking, sedatives (benzodiazepines) or opioids, do not stop all at once without medical supervision, because withdrawal can be dangerous.
Untie is not an emergency service. No one monitors what is written in the app in real time.
4. The companion
The companion is artificial intelligence software (Anthropic's Claude model), not a person and not a professional.
It can make mistakes, misunderstand, invent details or give advice that does not fit you. Do not rely on it for medical, legal or financial decisions.
It will not help obtain substances, give doses or help with anything that puts you or others at risk. When there is a sign of danger, it points to emergency numbers.
Using the companion requires a separate consent to send your conversation to Anthropic in the United States, and you can turn it off in Settings. Details are in the Privacy Policy.
Do not try to make the companion bypass its safety rules or use it to produce prohibited content.
5. Community rules
The community is a place to share what helped you, under a pseudonym. To keep it safe it has clear rules and zero tolerance for objectionable content and abusive users.
Do not:
Insult, threaten, harass, shame or discriminate against anyone.
Encourage use, sell, buy or point to where substances can be obtained.
Give doses or instructions for use.
Encourage harm to yourself or others.
Post identifying details such as names, phone numbers, addresses, links or photos, of yourself or others.
Post ads, spam, sexual content or content that infringes the rights of others.
Impersonate another person or a professional.
Reporting and blocking. Every insight has a report button. A reported insight is hidden at once until the team reviews it, and the team reviews reports within 24 hours. You can also hide all insights from a specific writer. Report any problem to shonm1921@gmail.com.
Enforcement. We may remove any content that breaks these rules and end access to the community, or to the whole app, for anyone who breaks them, without prior notice.
What you share. You are responsible for what you share. When you share an insight, you give us a non-exclusive, royalty-free permission to show it in the community for as long as it is not deleted. You can delete it at any time.
6. Your account, recovery code and device
Untie has no username or password. Your account is an anonymous ID kept on your device. The recovery code is the only way to move your data to a new device, and whoever holds it can see your data. Keep it private. If the code is lost, we have no way to restore your data. You are responsible for securing and locking your device.
7. Prohibited use
Do not use Untie against the law or these terms, and in particular do not:
Try to break into the system, bypass limits or security measures, or exploit vulnerabilities without reporting them to us.
Automate the service, scrape content or overload it.
Copy, modify, distribute, sell or reverse engineer the app, beyond what the law expressly allows.
Collect information about other users or try to identify them.
8. Payments
Untie is currently free to use, and the 90-day program is shown as a demo with no actual charge. If purchases are offered in the future, they will be made only through Apple's App Store, under Apple's payment, cancellation and refund terms, and the price and terms will be shown before every purchase. Any special terms for such purchases will be published in advance and become part of these terms. They do not limit your rights under consumer protection law.
9. Intellectual property and license
The app, its design, illustrations and scenes, texts, professional content and code belong to Untie or to those who licensed them to Untie. We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the app on devices you own or control, for personal non-commercial use, under these terms and the App Store Usage Rules. What you write in your journal and check-ins belongs to you.
10. Availability and changes to the service
We try to keep the service available, but we do not promise uninterrupted availability. Parts that need the server, such as the companion, the community and sync, may sometimes be unavailable. Home, the urge button, check-ins and Learn work offline. We may change, add or discontinue parts of the service. Before discontinuing the whole service we will give notice in the app, so you can download a copy of your data.
11. Limitation of liability
We make reasonable efforts to keep the app working well and its information accurate. Still, the service is provided "as is" and "as available", and it may contain errors, interruptions and mistakes.
The outcome of quitting or cutting down depends on many factors, and we do not promise any particular result.
To the fullest extent the law allows, Untie is not liable for indirect, consequential or special damages, or for damage caused by relying on information in the app or on the companion's replies instead of contacting a doctor or emergency services, or by content other users posted.
To the fullest extent the law allows, Untie's total liability to you will not exceed the amount you paid Untie, if any, in the 12 months before the event.
Nothing in these terms limits liability that the law does not allow to be limited, such as liability for death or personal injury caused by negligence, or for fraud, and nothing limits your rights under consumer protection law.
12. Indemnity
If a claim is brought against Untie because of content you posted in the community or your use of the app against these terms or the law, you will indemnify Untie for the resulting damage and reasonable costs, after we notify you of the claim and let you defend against it.
13. Termination
You can stop using the app at any time and delete all your data in Settings. We may suspend or end access for anyone who breaks these terms or the law. Sections that by their nature should survive, such as intellectual property, limitation of liability, indemnity and governing law, survive termination.
14. Terms regarding Apple
If you downloaded Untie from the App Store:
This agreement is between you and Untie only, not with Apple Inc. Untie, not Apple, is solely responsible for the app and its content.
The license in section 9 is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
Untie, not Apple, is responsible for maintenance and support of the app. Apple has no obligation to provide any maintenance or support.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
Untie, not Apple, is responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
If a third party claims that the app or your use of it infringes their intellectual property, Untie, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.
You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
You must comply with applicable third-party terms when using the app, such as your wireless data service agreement.
Apple Inc. and its subsidiaries are third-party beneficiaries of these terms, and upon your acceptance Apple has the right to enforce them against you.
15. Changes to these terms
We may update these terms. A material change will be announced in the app before it takes effect, and where needed we will ask for your consent again. Continuing to use the app after the change takes effect means you accept it. The version number and effective date always appear at the top of this page.
16. Governing law and jurisdiction
These terms are governed by Israeli law only, without its conflict of laws rules. The competent courts in Tel Aviv-Yafo have exclusive jurisdiction. This does not take away any right you have under mandatory law in the country where you live.
17. General
If any provision is found invalid, the rest remain in force. Waiving one breach does not waive another. Untie may assign its rights and obligations under these terms to a party that continues to operate the service, subject to the Privacy Policy. If the Hebrew and English versions conflict, the Hebrew version prevails.
